Muerte y resurrección del delito de escarnio en la jurisprudencia española

Abstract

[Resumen] En los últimos años, hemos asistido al resurgir mediático de un delito que parecía olvidado: el escarnio de las creencias religiosas, previsto en el art. 525 del Código penal. En efecto, ha saltado a la primera plana de los medios de comunicación la presentación de querellas frente a programas de humor, artistas, personajes públicos, etc. por haber ofendido los sentimientos de los creyentes con sus actuaciones. En el presente estudio, se analiza, en primer lugar, el mencionado precepto desde el punto de vista teórico. En segundo lugar, se estudian, una a una, todas las resoluciones judiciales que han aplicado el art. 525 desde su entrada en vigor hasta la fecha. Por último, se realizan una serie de consideraciones sobre la resurrección jurisprudencial del delito de escarnio de las creencias religiosas (que, hasta tiempos recientes, había sido una anécdota en el panorama judicial español), encuadrándola en un contexto más amplio de resurgimiento de un pensamiento identitario de corte religioso en nuestra sociedad.

[Abstract] In recent years, we have witnessed in the media a revival of a crime that seemed to be forgotten: the derision of religious beliefs, foreseen in art. 525 of the Criminal Code. In fact, the presentation of complaints against humor programs, artists, public figures, etc. for having offended the feelings of the believers with their actions has jumped to the front page of the media. In this study, the author analyzes the aforementioned precept from the theoretical point of view. Secondly, he examines, one by one, all judicial decisions that have applied the art. 525 from its entry into force to date. Finally, It is followed by a series of considerations on the resurrection of this offense of derision of religious beliefs (which, until recently, had been an anecdote in the Spanish judicial scene), placing it in a broader context of resurgence of an identity feeling in our society.
