Abstract
[Resumen] El ejercicio de las funciones públicas inherentes a la actividad marítima requiere de una organización administrativa diseñada en función de la complejidad de estas tareas. Teniendo en cuenta el reparto competencial diseñado por la Constitución, tal estructura se incardina, principalmente, en la Administración General del Estado. Así, a la hora de hablar de Administración marítima, el Legislador se refiere, básicamente, a la Dirección General de la Marina Mercante. Sin embargo, del esquema organizativo de la Administración Estatal se puede vislumbrar como tal órgano no atiende a la complejidad del fenómeno marítimo, habida cuenta de los diferentes entes con competencias en la materia. Por ello, en este trabajo se analizan el papel de la acción del mar en la estructura administrativa del Estado para verificar su óptimo encuadre organizativo.
[Abstract] The exercise of the public functions inherent to maritime activity requires an administrative organization designed according to the complexity of these tasks. Considering the distribution of competences designed by the Constitution, such a structure is mainly included in the General Administration of the State. Thus, when speaking of the maritime Administration, the Legislator basically refers to the Directorate General of the Merchant Navy. However, it can be seen from the organizational scheme of the State Administration that this body does not consider the complexity of the maritime phenomenon, given the different entities with competences in this area. For this reason, this paper analyses the role of maritime action in the State’s administrative structure in order to verify its optimal organizational framework.
