Abstract
[Resumen] Durante los siglos de dominación española en América, se aplicó a los indios el
estatuto jurídico de miserables personae tal como había sido desarrollado en Europa por
la doctrina de los juristas. Este artículo examina los privilegios de índole procesal de
que gozaron los naturales americanos al amparo de dicho estatuto y destaca de forma
especial la importancia del beneficio de la in integrum restitutio.
[Abstract] During the centuries of Spanish rule in the Americas, the legal status of miserables personae was applied to Indians exactly as it had been developed in Europe through the doctrine of the jurists. This article examines the privileges of a procedural nature that Native Americans enjoyed under this status and especially highlights the importance of the benefit of in integrum restitutio.
