El impacto de la Ley Rider en la reducción del empleo informal en España

Abstract

[Resumen] Mediante este trabajo lo que se busca es analizar la figura del rider y la evolución que ha tenido en el marco de la economía digital, haciendo especial hincapié al impacto jurídico y social que ha supuesto la denominada Ley Rider. A través de este enfoque jurídico-laboral, se pone una lupa sobre los cambios normativos que se han ido introduciendo, las condiciones de trabajo que existían previamente y las posteriores a su entrada en vigor, así como las tensiones que han surgido recientemente entre plataformas digitales y el sistema jurídico. Dando también cierto respaldo a las percepciones de los propios trabajadores, las estrategias de las empresas para adaptarse (o eludir) la nueva normativa, y los primeros datos que se están empezando a atisbar sobre sus efectos reales. El análisis se ve completado en última instancia con una mirada desde la gestión de personas y la necesaria transformación del modelo organizativo en el trabajo digital, invitando a reflexionar sobre los límites legales que hay sobre la mesa para afrontar la precariedad laboral en escenarios emergentes.[Abstract] This paper seeks to analyse the figure of the rider and how it has evolved within the digital economy, with particular emphasis on the legal and social impact of the so-called Rider Law. Through this legal-labour approach, we take a close look at the regulatory changes that have been introduced, the working conditions that existed before and after its entry into force, as well as the tensions that have recently arisen between digital platforms and the legal system. It also provides some support for the perceptions of the workers themselves, the strategies of companies to adapt to (or circumvent) the new regulations, and the first data that is beginning to emerge on their real effects. The analysis is ultimately completed with a look at people management and the necessary transformation of the organisational model in digital work, inviting reflection on the legal limits that are on the table to address job insecurity in emerging contexts.
