Abstract
[Resumo] Neste traballo analízase o uso que os traballadores fan das tecnoloxías da información e as comunicacións (TIC) en relación co seu dereito á intimidade, en contraposición co dereito á supervisión e á vixilancia de que gozan os empresarios na esfera da relación laboral existente entre empregados e empregadores. En especial, estúdase o impacto que pode chegar a ter a vixilancia sobre as TIC por parte do empresariado no tocante aos dereitos fundamentais dos traballadores. Así mesmo, examínanse as posibles consecuencias do citado uso tanto na orde social (despedimento) como na orde penal, tendo en conta a capacidade de control e supervisión que pode exercer a empresa para verificar se os traballadores, cando utilizan os instrumentos de que son provistos, desempeñan de forma axeitada a súa función ou se dan casos de deslealdade ou de falta de rendemento no traballo.
[Abstract] This paper discusses the use that workers do of ICTs in relation with their right to privacy as opposed to the employer’s right to supervision and surveillance within the occupational sphere. In particular, it deals with the impact that employer’s surveillance may have over the worker fundamental rights. Likewise, it examines the possible consequences that ICTs use may have both over the social order (dismissal) and the penal order. For that, we take into consideration the control and supervising abilities that the company can exert in order to verify that the workers perform their duties properly whenever they are using them at work or if there may be disloyalty and lack of performance otherwise
