Sobre indemnización a trabajadores interinos: STSJ Madrid, de 5 octubre 2016 (AS 2016, 1298)

Abstract

[Resumen]: El comentario versa sobre la incidencia de la Sentencia del Tribunal Superior de Justicia de la Unión Europea de 14 de septiembre de 2016, que recoge el órgano consultante (Tribunal Superior de Justicia de Madrid) en sentencia de 5 de octubre de 2016, pues establece que los interinos por sustitución, a la finalización de los contratos sean indemnizados con 20 días de salario por año trabajado. Y si ello pudiera influir en la indemnización de otros contratos de duración determinada a su finalización.

[Abstract]: This article reviews the ruling of the European Court of Justice of 14th September 2016, and the subsequent judgment of the High Court (TSJ) of Madrid of 5th October 2016, which declared the right of an interim replacement employee of the Public Administration to compensation of 20 days of salary per year worked for the legal termination of their contract. The article analyses whether this judgement could have potential consequences on the severance pay of comparable permanent workers upon termination of their contracts.
