Abstract
[Abstract]: This paper examines the offence of computer fraud in the Spanish legal system, addressing the challenges posed by the incorporation of artificial intelligence into the field of computer crime. It analyses the international, European, and national regulatory framework, as well as the legislative evolution of this offence up to its current configuration in Article 249 of the Spanish Criminal Code following the reform introduced by Organic Law 14/2022. It also provides a dogmatic analysis of the offence and assesses the impact of artificial intelligence, both as a tool facilitating criminal conduct and as an instrument serving its prevention, concluding with a reflection on the need for a comprehensive legal response that respects criminal-law safeguards.
