Los agentes marítimos y su rol como porteadores en el Derecho Peruano

Abstract

[Resumen] Este trabajo analiza el papel que tienen diversos empresarios que realizan actividades de intermediación en las operaciones de trasporte marítimo de mercancías, especialmente cuando asumen las obligaciones de porteador marítimo. En la legislación peruana, el estatuto jurídico de estos empresarios está regulado de forma dispersa y, en algunos casos, esta regulación es inexistente. La propuesta central de este artículo consiste en explicar el rol de porteador contractual que pueden asumir figuras tales como consignatario de buques, los agentes marítimos y los transitarios aplicando la teoría general de la representación y la regulación del contrato de comisión de transporte.

[Abstract] This paper analyzes the role played by various entrepreneurs who carry out intermediation activities in maritime freight transport operations, especially when they assume the obligations of maritime carrier. In Peruvian legislation, the legal status of these entrepreneurs is regulated in a scattered manner and, in some cases, this regulation does not exist. The central proposal of this paper consists of explaining the role of maritime carrier that figures such as ship consignees, maritime agents and freight forwarders can assume by applying the general theory of representation and regulation of the transport commission contract.
