Abstract
[Resumen]: La objeción de conciencia es un derecho derivado de la libertad de conciencia que ha dado lugar a amplios debates en el Derecho español. Vinculado inicialmente a la negativa a realizar el servicio militar, cada vez son más los ámbitos en que se demanda su reconocimiento y garantía. Ni el legislador ni la jurisprudencia han articulado este derecho de manera coherente hasta ahora. El artículo analiza la definición y naturaleza de la objeción de conciencia, en general, y los tres supuestos en que ha sido reconocida en España: objeción de conciencia al servicio militar, al aborto y a la eutanasia.
[Abstract]: The objection of conscience is a part of the freedom of conscience. The recognition of this right has been controversial in Spanish Law. It was first linked to the refusal to do the military service but, after the Constitution of 1978, its scope widened. Neither the lawmakers nor the case law have issued an articulated response to the challenges posed by this right. The paper deals with the definition and nature of the objection of conscience in Spain. Afterwards, it analyzes the kinds of objection of conscience recognized in the juridical system: to the military service, to perform abortions and to intervene in the euthanasia.
