La inteligencia artificial como autora y sujeto de la propiedad intelectual. Apropiación del saber social y dominación en el Tecnocapitalismo

Abstract

[Resumen] El empeño del ser humano por desarrollar y enriquecer el conocimiento es tan antiguo como el conflicto por apropiarse del mismo en beneficio privado. Este histórico enfrentamiento político será nuestro objeto de estudio. Frente a la unidimensional visión individualista del desarrollo del saber hegemónica desde la Ilustración, se propondrá otro modelo alternativo que ponga en valor también los aspectos sociales de su creación, distribución y preservación. A la vista de esta concepción del saber social se analizarán diversos aspectos del conflicto desde su dimensión histórica, filosófica, política, jurídica, sociológica y económica. Se pretende, con esta visión holista, concretar un problema capital que en nuestros días, con el desarrollo agudo de la propiedad intelectual, afecta a todos los ámbitos de la vida pública y privada. En la segunda parte de la tesis nos centraremos en la dialéctica entre tres fenómenos de última hora: el desarrollo de la IA y la robótica automática, el incipiente discurso del maquinismo impulsado por los poderes tecnocapitalistas, y el desarrollo paralelo de la PI que permite la nueva apropiación del saber desarrollado con ayuda de la supercomputación. Se analizará, como caso paradigmático, el discurso que propone que la máquina debe ser reconocida como persona electrónica responsable, luego como autora y ser creativo, y, al fin, como sujeto de la propiedad intelectual.[Abstract] The human endeavor to develop and enrich knowledge is as old as the conflict to appropriate it for private benefit. This historical political confrontation will be our object of study. In contrast to the one-dimensional individualistic vision of the development of knowledge hegemonic since the Enlightenment, we will propose an alternative model that also values the social aspects of its creation, distribution and preservation. In view of this conception of social knowledge, various aspects of the conflict will be analyzed from its historical, philosophical, political, legal, sociological and economic dimensions. With this holistic vision, the aim is to specify a major problem that nowadays, with the acute development of intellectual property, affects all areas of public and private life. In the second part of the thesis, we will focus on the dialectic between three new phenomena: the development of artificial intelligence and automatic robotics, the incipient discourse of machinism driven by the technocapitalist powers, and the parallel development of intellectual property that allows the new appropriation of knowledge developed with the help of supercomputing. As a paradigmatic case, we will analyze the discourse that proposes that the machine should be recognized as a responsible electronic person, then as an author and creative being, and finally as a subject of intellectual property.
