Abstract
[Resumen] Si el riesgo de judicialización puede predicarse de los tribunales en general,
en el caso del Tribunal Constitucional puede alcanzar una relevancia y una repercusión
mayor debido a la trascendencia de su jurisprudencia. El vigente régimen de
admisibilidad del recurso de amparo ha provocado un cambio en la naturaleza del
recurso, por haber asumido el TC ese nuevo papel que tanto le acerca a la labor propia
del Legislador y le va alejando de los sujetos jurídicos perjudicados. Cada vez, es mayor
el peligro de la extralimitación del Poder ejecutivo y la consiguiente instrumentalización
de la Justicia, con tal de obtener resoluciones que avalen su labor ejecutiva
[Abstract] If the risk of judicialisation may be appreciated in relation to general courts, in the case of the Constitutional Court can achieve greater relevance and impact due to the significance of its jurisprudence and case law. The current system of admissibility of “amparo” appeals has caused a change in the nature of this constitutional action, having been assumed by the CC this new role that brings it closer to the task of the legislator, moving it away from the injured parties. The danger of overreaching of the executive branch and the subsequent instrumentalization of Justice in order to obtain judgments supporting its executive work are greater each time
