Abstract
[Resumen] Este trabajo pretende reflexionar sobre la conveniencia de mantener, como par-
cela académica, a la más antigua de las disciplinas jurídicas: el Derecho Romano. Es
oportuno por cuanto pueda verse afectado, por la aplicación y desarrollo del RD
1393/2007, de 29 del 10, sobre la ordenación de las enseñanzas universitarias oficiales.
Responde al momento actual de construcción del Espacio Europeo de Educación
Superior y al compromiso del Gobierno español de que en el año 2010 todas las ense-
ñanzas universitarias deban estar adaptadas a su nueva estructura. Y se basa: a) en el
carácter a que debe responder toda Educación jurídica, ni solo teoría, ni solo práctica,
sino análisis intelectual a la práctica y b) en la coherencia y legitimidad de poder llamar
jurista, a quien en ella se eduque.
[Abstract] This work tries to reflect on the convenience of keeping, as an academic field, the most ancient of the legal disciplines: Roman Law. It is appropriate, because of how much it could be affected by the application and development of Royal Decree 1393/2007 of October 29th concerning the arrangement of official university education. It corresponds to the current moment of construction of the European Space of University Education and to the commitment of the Spanish government’s; commitment to ensure that all university education should be adapted to the new structure by 2010. And it is based: a) on the character to which all legal education respond, which is nei- ther theory alone, nor practice alone, but intellectual analysis of practice and b) on the coherence and legitimacy of being able to call a jurist whoever has been educated in this system.
