Abstract
[Resumen]: La ausencia de regulación específica en lo que se refiere a la ejecución de las penas impuestas a la persona jurídica condenada se traduce en una laguna legal que es necesario suplir acudiendo a la legislación procesal civil, civil, penal, mercantil o administrativa, según los casos. El trabajo examina cada una de las penas previstas en el Código Penal para las personas jurídicas; hace referencia a las particularidades que, en ejecución, podrían derivarse de la naturaleza especial-preventiva de las penas restrictivas de derechos imponibles a las personas jurídicas; refiere los problemas derivados de la facilidad con que una persona jurídica puede acometer modificaciones estructurales o disolverse; y en último lugar, se referirán los instrumentos que existen para ejecutar, fuera del territorio español, las condenas de personas jurídicas, así como las lagunas normativas que se aprecian en este ámbito
[Abstract]: The absence of specific regulations regarding the enforcement of penalties imposed on convicted legal entities results in a legal loophole that must be filled by resorting to civil, criminal, commercial or administrative procedural law, depending on the case. The paper examines each of the penalties provided for in the Criminal Code for legal persons; it refers to the particularities that, in enforcement, could arise from the special preventive nature of penalties restricting the rights of legal persons; it refers to the problems arising from the ease with which a legal person can undertake structural changes or dissolve; and finally, it refers to the instruments that exist for enforcing sentences against legal persons outside Spanish territory, as well as the regulatory gaps that can be seen in this area.
