Abstract
[Resumen] El creciente número de inmigrantes ha sido tratado con sospecha, sobre todo, con posterioridad a los ataques terroristas. Actualmente se observan altos niveles de desconfianza, el endurecimiento de las políticas e intolerancia dirigidas a los delincuentes extranjeros, una reacción idéntica se da frente a la irregularidad. La percepción del inmigrante como “otro”, un outsider, un potencial enemigo cuya presencia requiere un esfuerzo preventivo a través de medidas de seguridad nos condujo a reflexionar sobre la posible emergencia del Derecho Penal del “crimigrante”.
[Abstract] Migratory movements have been viewed with progressive suspicion, especially after the terrorist attacks. Currently, there is a feeling of mistrust, a toughening of policies and an intolerance towards non-national offenders that is similar to the reaction to irregularity. This perception of the immigrant as the ‘other’, the outsider, the potential enemy whose presence requires a preventive reinforcement of security measures, motivated us to reflect on the possible emergence of the Criminal Law of the Crimmigrant.
