Abstract
[Resumen] En la Europa unida, se ha considerando tradicionalmente que la protección de los
trabajadores constituye un límite claro de la libertad de prestación de servicios, a pesar
del carácter fundamental de esta última. La virtualidad de este límite ha suscitado un
debate muy vivo en la actualidad, como consecuencia de la propuesta de Directiva,
adjetivada «Bolkestein», especialmente en su versión originaria de 2004. Ahora bien, la
modificación de esta última –materializada sobre todo en la eliminación del «principio
del país de origen»– no cierra en absoluto este debate tan actual, puesto que no dejará
de influir en el territorio de la Unión Europea el denominado «modo 4» del Acuerdo
General sobre el Comercio de Servicios, que claramente implica un resurgimiento del
«principio del país de origen», tan criticado por los sindicatos.
[Abstract] In the united Europe, it has been considered traditionally that the protection of the employees constitutes a clear limit of the freedom to provide services, in spite of the fundamental character of this last one. The potentiality of this limit has provoked a very alive discussion at the present time, as a result of the Proposal for a Directive, described «Bolkestein», specially in its original version of 2004. However, the modification of this last one –materialized mainly in the elimination of the «country of origin principle »– it does not close absolutely this so present discussion, because it will not let influence in the territory of the European Union the denominated «mode 4» of the General Agreement on Trade in Services, that implies a resurgence of the «country of origin principle», so criticized by the trade unions.
