Abstract
[Resumen] La conceptualización de los Derechos Sexuales y Reproductivos representa una reciente innovación normativa, asumida con diferente compromiso e intensidad en función de cada país o ámbito regional. Su protección y reconocimiento confronta, no sólo con los monoteísmos y los posicionamientos más conservadores herederos del mandato histórico patriarcal de control y explotación sexual y reproductiva de las mujeres, sino con una creciente industria globalizada que mercantiliza dicha explotación. Su tratamiento jurídico en el ámbito de las Naciones Unidas ha sido abordado desde tres líneas de actuación: como vis expansiva de los Derechos Humanos reconocidos en los Tratados, como parte integral de las Políticas de Población y Desarrollo y de forma específica en las Conferencias Mundiales de Mujeres. El sesgo androcéntrico en su configuración, la falta de un marco jurídico propio y vinculante, así como la ausencia de efectivos mecanismos sancionadores ante su vulneración, obliga necesariamente a repensar y formular, un cambio de paradigma en la técnica jurídica, con el reto de abordar un modelo que elimine el sesgo androcéntrico excluyente, producto del pacto originario, que ha venido caracterizando la Teoría del Estado y la Teoría del Derecho.
[Abstract] The conceptualization of Sexual and Reproductive Rights represents a recent normative innovation, assumed with different commitment and intensity depending on each country or regional scope. Its protection and recognition confronts not only monotheisms and more conservative positions inherited from the historical patriarchal mandate of control and sexual and reproductive exploitation of women, but also with a growing globalized industry that commodifies such exploitation. Its legal treatment in the United Nations has been addressed from three lines of action: as an expansive vision of the Human Rights recognized in the Treaties, as an integral part of Population and Development Policies and specifically in the World Confere nces of Women. The androcentric bias in its configuration, the lack of a proper and binding legal framework, as well as the absence of effective sanctioning mechanisms in case of its violation, necessarily requires us to rethink and formulate a paradigm sh ift in legal technique, with the challenge of addressing a model that eliminates the exclusive androcentric bias, product of the original pact, which has characterized the Theory of the State and the Theory of Law.
