Abstract
[Resumen]: En las siguientes páginas se analizan los impactos producidos en las políticas de compliance de las Administraciones locales a resultas de la gestión de los fondos Next Generation. La regulación jurídica que acompaña a estos fondos europeos y, en particular, la obligada adopción de medidas antifraude ha supuesto que sus gestores y destinarios tuviesen que implementar instrumentos de prevención y control creados en el ámbito del cumplimiento normativo y, tradicionalmente, aplicados por personas jurídico-privadas (mapas de riesgo, declaraciones de conflicto de intereses, canales de denuncia…). La aplicación irreflexiva y sin el debido análisis de contexto de estas medidas, desconociendo la naturaleza pública y las características de las entidades locales, puede conllevar, en muchos casos, más problemas que soluciones.
[Abstract]: The article analyzes the impacts on local administrations’ compliance policies resulting from the management of the NextGenerationEU funds. The regulations accompanying these European funds, particularly the mandatory adoption of anti-fraud measures, have led their managers and recipients to implement prevention and control tools that originated in the field of regulatory compliance and were traditionally applied by private legal entities (risk maps, conflicto of interest declarations, whistleblower channels, etc.). The unreflective application of these measures without proper contextual analysis, ignoring the public nature and characteristics of local entities, can often lead to more problems than solutions.
