Abstract
[Resumen] El artículo intenta, a través del análisis de la práctica de los tribunales italianos,
demostrar que, frente a lo que habitualmente se predica sobre la lucha contra el terro-
rismo internacional, en el sentido de entender la misma como una manifestación de la
excepcionalidad penal, las prácticas atentatorias contra una correcta interpretación del
derecho y de las garantías procesales no derivan sino de la práctica habitual de los tri-
bunales, y de la función simbólica que éstos asumen en la configuración de las repre-
sentaciones sociales.
[Abstract] The paper tries, across the analysis of the Italian courts practice, to demonstrate that, opposite to what habitually is told on the fight against international terrorism, understanding this as exceptional criminal law manifestation, the unlawful practices against a correct interpretation of Law and of procedural guarantees do not derive but of the habitual practice of the courts, and of the symbolic function that these assume in the social representations configuration.
