Abstract
[Resumen] La reforma del Derecho colectivo del Trabajo operada por el Real Decreto-ley 3/2012 ha sido menos profunda que la del Derecho individual del Trabajo. Se ha centrado en tres temas, relativos al descuelgue de empresas de los convenios colectivos sectoriales, a la eliminación de los restos de la tradicional prohibición de concurrencia de convenios colectivos y, por último, en poner una fecha límite a la ultractividad de los convenios. Este trabajo concluye con una crítica de la reforma operada, puesto que no ha dado ningún paso adelante en la tarea de desfranquistizar y desfascistizar nuestro sistema de relaciones laborales colectivas.
[Abstract] The reform of the Collective Labor Law performed by the Royal Decree-act 3/2012 has been deeper than the one of the Employment Law. It has been focused on three subject-matters, relating to opt enterprises out from the sectoral collective bargaining agreements, to the elimination of the remainder of the traditional prohibition of concurrence of collective bargaining agreements, and lastly, in stating a deadline to the ultractivity of the agreements. This study concludes with a criticism of the reform performed, since it has not suppose any step ahead in the task of «desfranquistizar» and «desfascistizar» our system of collective labor relations.
