[Resumen]: El caso Glacier Northwest, decidido en 2023, es la última palabra de la Corte Suprema de los Estados Unidos sobre el tema de las huelgas no preavisadas al empresario. Según él, dichas huelgas son legales, siempre y cuando los huelguistas no incumplan su deber de prevenir los riesgos para las personas y para el patrimonio empresarial causados por la huelga no preavisada. Siempre según dicho caso, este deber se incumple si los huelguistas tenían la intención de poner en riesgo el patrimonio empresarial, sin que sea necesario que el patrimonio empresarial resulte de hecho dañado
[Abstract]: Glacier Northwest case, decided in 2023, is the last word of the United States Supreme Court on the topic of unnoticed strikes to employer. According to it, such strikes are lawful, as long as the strikers do not violate their duty to prevent risks for persons and employer equipment caused by the unnoticed strike. Always according to said case, this duty is violated when the strikers intended to place at risk the employer equipment, not being necessary for the employer equipment to result in fact damaged.
