Abstract
[Resumen] El Real Decreto Ley 6/2019, de 1 de marzo, de medidas urgentes para garantía de la igualdad de trato y de oportunidades entre mujeres y hombres en el empleo y la ocupación, acomete diversas reformas en la materia de maternidad y conciliación en el trabajo por cuenta ajena. El estudio se dedica a su análisis específico. En particular, se analiza el nuevo permiso por nacimiento y cuidado de menor, que es indudablemente la reforma con mayor impacto sobre la opinión pública pues a través de ese permiso se materializa el incremento del permiso a favor del progenitor distinto de la madre biológica hasta la duración del permiso a favor de la madre biológica. También se analizan las modificaciones en el permiso por cuidado de lactante, en el derecho a la adaptación de la jornada de trabajo y en las garantías de ejercicio de derechos de maternidad y paternidad. Se finaliza el estudio con unas conclusiones críticas, y con el deseo de que el decreto ley se convierta en ley formal.
[Abstract] Summary: The Royal Decree-Law 6/2019, dated 1 March, on urgent actions to guarantee equal treatment and opportunities between women and men in employment and occupation, undertakes various amendments in the area of maternity and work-life balance. The study is dedicated to its specific analysis. In particular, it is analysed the new birth and child care permission, which is undoubtedly the amendment with the greatest impact on public opinion, since this permission materializes the increase of the permission duration in favour of the parent other than the biological mother until the duration of the permission in favour of the biological mother. Moreover, it is also analysed the changes in the nursing care permission, in the right to the adaptation of the workday and in the guarantee of the exercise of maternity and paternity rights. The study is finished with critical conclusions, and with the desire that the decree-law becomes a formal law
