Abstract
[Resumen] La ley 5/2006, de 10 de mayo, del libro quinto del código civil de Catalunya, unifica
el régimen de los derechos reales en Cataluña, derogando y completando el conjunto de
leyes en la materia. Pretende regular de forma completa y autosuficiente el derecho de usufructo,
frente a la regulación anterior que se centraba en algunas especialidades. Se regula
ex novo el derecho de aprovechamiento, derecho de uso parcial en beneficio de una persona
y no de una finca. La nueva ley mejora la sistemática de las servidumbres forzosas y
racionaliza los plazos de la extinción por no-uso y de la acción confesoria y su relación con
la acción negatoria. La ley perfecciona la regulación anterior del derecho de superficie,
aportando elementos de seguridad, así como un amplio margen a la regulación voluntaria.
[Abstract] The law 5/2006, of the 10th of May, of the fifth book of the civil code of Catalonian, unifies the regime of the real rights in Catalonia, repealing and completing the ensemble of existing laws. The law intends to regulate the right of usufruct in a complete and self-sufficient way, in front of the previous regulation that was pointed on some specialities. The law regulates ex novo the right of exploitation, a right of partial use for the benefit of a person and not of an estate. The new law improves the systematics of the obligatory servitude and rationalizes the terms of the extinction for notuse and of the confessoria action and its relationship with the negatoria action. The law perfects the previous regulation on surface right, providing the voluntary regulation with elements of security, as well as a wide margin of voluntary regulation.
