Abstract
[Resumen] El transporte marítimo de mercancías en el marco de la economía azul
incorpora una nueva perspectiva del transporte y la navegación marítima en un
momento en el que el ser humano es consciente del elevado riesgo que están generando
la contaminación y el cambio climático para los ecosistemas de las distintas
especies que habitan en el mar y que son imprescindibles para nuestra supervivencia.
Nuestro objetivo en este trabajo es adelantar esa nueva perspectiva jurídica susceptible
de normativizarse en un futuro próximo en nuestro Derecho de la navegación
y del transporte marítimo de mercancías, siguiendo la estela de la preservación del
medio marino que está impulsando el Derecho comunitario.
Ello hará que nos fijemos en la regulación de tres aspectos fundamentales del transporte
de mercancías por vía marítima. El aspecto que afecta a la descarbonización
de los buques recurriendo a combustibles alternativos o sistemas de propulsión más
eficientes. El aspecto referido a la modernización de las infraestructuras portuarias
que aumenten su eficiencia y, en tercer lugar, el aspecto de la automatización de los
buques y el desarrollo de nuevas tecnologías en el sector marítimo, que optimicen
rutas y reduzcan riesgos y costes.
Description
[Abstract] Maritime transport in the framework of the blue economy incorporates a
new perspective of maritime transport of goods and navigation at a time when human
beings are aware of the high risk that pollution and climate change are generating
for the ecosystems of the different species that inhabit the sea and that are essential
for our survival.
Our aim in this paper is to advance a new legal perspective that could be regulated
in the near future in our navigation and goods' maritime transport law, following the
trail of the preservation of the marine environment that is being promoted by European
Union law.
This will lead us to look at the regulation of three fundamental aspects of maritime
transport. The aspect that affects the decarbonization of ships by resorting to alternative
fuels or more efficient propulsion systems. The aspect referring to the modernization
of port infrastructures to increase their efficiency and, thirdly, the aspect of
ship automation and the development of new technologies in the maritime sector to
optimize routes and reduce risks and costs.
