Abstract
[Resumen]: La condición de ministro de culto tiene relevancia en algunos
sectores del ordenamiento, que introducen especialidades en el régimen jurídico
aplicable a quienes ostentan esta condición. Estas particularidades no
alcanzan, en principio, a la libertad de expresión. Los ministros de culto pueden
ejercitar este derecho en las mismas condiciones que cualquier otro ciudadano.
Sin embargo, al analizar los límites de este derecho, aparecen situaciones
en las que la condición de ministro de culto forma parte del contexto
que ha de tenerse en cuenta para decidir si hay o no vulneración del derecho
o para graduar la pena. El artículo realiza, en primer lugar, una serie de observaciones
sobre la figura del ministro de culto. A continuación se expone la
regulación y el contenido del derecho a la libertad de expresión en el ordenamiento
jurídico español. Por último, se analizan los límites de la libertad de
expresión y la relevancia que puede tener la condición de ministro religioso en
cada uno de estos supuestos.
[Abstract]: Religious ministers have the right to exercise their freedom of expression as everybody else, as they do not enjoy a special status in the Spanish juridical system. The Law only recognizes some specialties in their situation when it is needed to guarantee the exercise or religious freedom. However, in some cases, being a religious minister may have an impact on the limits of the right to freedom of expression, as part of the context; it may also be relevant to determine the sanction of a certain action. This article deals, first of all, with the definition of religious minister in Spanish Law. Then, it analyzes the regulation and content of the freedom of expression. Afterwards, it examines the limits of the freedom of expression and the relevance that being a religious minister may have in those cases.
