Abstract
[Resumen] Los cambios en la cadena de
suministro y la aplicación de las nuevas tecnologías
en el campo de la logística están dando
lugar a nuevas prácticas que, pudiendo refl ejar
principios ya conocidos, descubren nuevos
retos para las normas jurídicas. El ejemplo en
el que se centra este trabajo son los documentos,
registros o tokens representativos
de mercancía ocasionalmente emitidos por
prestadores de servicios logísticos, con apoyo
en las herramientas creadas para la visibilidad
de la cadena de suministro, y con la fi nalidad
de habilitar la prestación de servicios fi nancieros
empleando la mercancía como garantía.
Los instrumentos sobre documentos transmisibles
o, en general, sobre activos digitales,
algunos en fase de construcción, proporcionan
principios útiles a la hora de valorar las
particulares características de este y algunos
otros fenómenos, claramente originados por
la innovación en los negocios.
[Abstract] The evolution of the supply chain and the application of new technologies to logistic activities and services is giving rise to new practices that reflect old standing principles, but at the same time entail some new challenges from a legal perspective. This writing focuses on the example provided by records, registries or tokens of title to goods, occasionally issued by logistic services providers on the basis of tools for the visibility of the supply chain, with the particular purpose to structure trade fi nance relations that rely on the goods as collateral. Current instruments on transferable records or, in general, on digital assets (some of them under construction) provide rules and principles clearly useful to assess the particular features of these and other phenomena, so clearly shaped by innovation in businesses.
