Os direitos humanos das crianças com discapacidades: sejamos realistas, exijamos o (im)possível

Abstract

[Resumo] Os direitos humanos das crianças com discapacidades estão numa zona cinzenta, entre o seu reconhecimento e a sua inexistência, sendo o objetivo deste ensaio apresentar os fundamentos jus-filosóficos para a sua sustentabilidade. Para o efeito refletimos sobre as distintas teorias dos direitos subjetivos e o seu impacto no contexto da infância, predominantemente marcadas pelo individualismo jurídico. Na teoria dos contra-direitos (Gegenrechte Theorie) encontramos a mais sustentável crítica à perspetiva tradicional dos direitos subjetivos, que se move entre a vontade e os interesses. Por último, sustentamos os direitos das crianças como direitos de cidadania para a sua emancipação e expomos a normatividade contemporânea dos direitos das crianças com discapacidades, que evoluiu do modelo médico (CDC-1989) para o modelo de direitos (CDPD-2006).

[Abstract] The human rights of children with disabilities are in a grey zone, between their recognition and their non-existence, and the goal of this essay is present a jus-philosophical foundations for their sustainability. For this purpose, we reflect on the different theories of subjective rights and their impact on the context of childhood, predominantly marked by legal individualism. In the theory of counter rights (Gegenrechte Theorie) we find the most sustainable critique of the traditional perspective of subjective rights, which moves between 106 Anu Fac Der UDC, 2023, 27: 105-133the will and the interests. Finally, we support children's rights as citizenship rights and expose the contemporary normativity of rights for children with disabilities, which has evolved from the medical model (CRC-1989) to the rights model (CRPD-2006)
