Abstract
[Resumen:] En la idea de Estado de Derecho que propone Hayek, la predecibilidad de las decisiones de
los órganos públicos juega un papel importante. Para que esta sea posible, según Hayek es necesario
que las normas no sean vagas. Por otra parte, el autor considera también que la predecibilidad de las
decisiones judiciales aumentará, si quienes juzgan tienen en cuenta las ideas compartidas de lo que
es justo. Aunque estas ideas resultan sugerentes en un primer momento, un estudio más detenido
suscita numerosas reservas, tanto desde el punto de vista de la predecibilidad, como desde el de la
justicia. En este estudio se exponen algunas reflexiones críticas sobre estos planteamientos.
[Abstract] According to Hayek’s idea of the rule of law, the predictability of the decisions taken by public bodies plays a key role. In order for that to be possible, Hayek emphazises the need to avoid vagueness in the rules. Hayek also claims that the predictability of legal decisions will increase if those who judge bear in mind shared ideas of what is just. Although these approaches are attractive at first sight, closer inspection leads to a number of reservations in terms of predictability and of justice. This paper offers some critical reflections on Hayek’s thoughts in this regard.
