Abstract
[Resumen] El Atlántico Sur Occidental es el único espacio marítimo del Océano
Atlántico que carece de un instrumento institucional capaz de regular las actividades
pesqueras y de promover la colaboración entre los Estados ribereños y los actores
dedicados a la pesca en esta región. Este déficit de gobernanza se debe principalmente
a divergencias políticas entre Argentina y el Reino Unido respecto a la soberanía
de las Falklands/Islas Malvinas, que han obstaculizado el establecimiento de
una organización regional de ordenación de la pesca (OROP) en esta zona marítima.
Aunque la creación del instituto de la «entidad pesquera» permitió a Taiwán participar
en las OROP, desestimando las dudas sobre su personalidad jurídica internacional,
esto no pudo aplicarse a las Falklands/Islas Malvinas, por no cumplimiento de
los criterios normativos establecidos en los acuerdos sobre la materia. De hecho, la
falta de una OROP en la región ha resultado perjudicial para las comunidades ribereñas
debido a la falta de medidas de gestión de la pesca en alta mar.
[Abstract] The Western South Atlantic is the unique maritime space in the Atlantic Ocean that lacks an institutional framework capable of regulating fishing activities and fostering collaboration between coastal states and fishing operations stakeholders in this region. This governance deficit can be attributed primarily to the political disagreements between Argentina and the United Kingdom regarding the sovereignty of the Falklands/Malvinas Islands, which have thus far prevented the establishment of a regional fisheries management organization (RFMO) in this maritime space. While the establishment of the «fishing entity» institute enabled Taiwan to engage in the RFMO, it could not be applied to the Falklands/Malvinas Islands due to the failure to meet the established normative criteria in the relevant agreements. Indeed, the lack of an RFMO in the region has been detrimental to coastal communities due to the lack of high seas fisheries management measures.
