Abstract
[Resumen] Se trata de un nuevo enfoque acerca de los responsa prudentium romanos que
tendrían eficacia vinculante para el iudex privatus, quien respondía quasi ex delicto si
no tenía presente la communis opinio, incurriendo en fraus legis. Esta misma eficacia
vinculante tienen los “books of authority”, que en el derecho jurisprudencial de
Inglaterra asumieron la función de leyes.
[Abstract] It’s a new vision about the roman responsa prudentium that were binding for the iudex privatus, who responded quasi ex delicto if he didn’t follow the communis opinio, incurring in fraus legis. This same binding effect have the books of authority, that assumed the role of laws in the case law system of England.
