Abstract
[Resumen] La actual regulación del derecho de asociación en España, la Ley Orgánica
1/2002, establece la obligatoriedad de que todas las organizaciones que se acojan a esta
forma jurídica se doten de una estructura interna democrática. Dicha exigencia no pare-
cía ser la opción mayoritaria dentro de la mejor doctrina por considerarse que el ámbi-
to del asociacionismo es el de la libertad y el de los partidos el de la democracia. Esta
extensión de la normativa aplicada a partidos políticos y sindicatos a todo tipo de ente
asociativo no ha estado exenta de polémica, resulta de suma dificultad que cierto tipo
de organizaciones, por ejemplo las de la Iglesia Católica, mantengan un funcionamien-
to exclusivamente basado en la democracia cuando constitutivamente son organizacio-
nes jerárquicas.
[Abstract] The current regulation of the right of association in Spain, the Organic Law 1/2002, establishes the obligatory nature of which all the organizations that they recei- ve to this juridical form are provided with an internal democratic structure. The above mentioned exigency was not seeming to be the majority option inside the best doctrine for be thinking that the area of the associations is that of the freedom and that of the par- ties that of the democracy. This extension of the regulation applied to political parties and unions to all kinds of associative entity has not been exempt from polemic, ensues from supreme difficulty that certain type of organizations, for example those of the Catholic Church, support a functioning exclusively based on the democracy when for constitution are hierarchic organizations.
