Abstract
[Resumen]: El derecho a no ser discriminado y el derecho a vivir conforme a las propias convicciones religiosas están protegidos por nuestra Constitución, como en la mayoría de los Estados occidentales. En los últimos años, en algunos países se ha generado una polémica, en el ámbito de determinadas operaciones mercantiles, entre las normas que protegen la libertad religiosa y las que prohíben la discriminación por causa de la orientación sexual. Aunque en España no ha sido una cuestión problemática, es previsible que pueda plantearse este tipo de conflictos a la vista de las últimas reformas legislativas. El artículo examina esta controversia en el marco de la legislación vigente.
[Abstract]: The right not to be discriminated and the religious liberty are protected by the Spanish Constitution, as in most Western juridical systems. In the last years, some controversies between the laws protecting religious freedom and those prohibiting discrimination based on sexual orientation arose in the commercial contracts field. This has not been the case in Spain, but it is foreseeable that similar conflicts may arise in view of the latest legislative reforms. This article examines this specific issue within the framework of the current legislation.
