Abstract
[Resumen] La actividad de manipulación portuaria comprende un conjunto de operaciones de naturaleza fundamentalmente técnica y material, realizadas antes y después del traslado de mercancías, que se desarrolla en el ámbito portuario. Estas operaciones resultan imprescindibles para la efectiva ejecución del transporte de carga. Si bien existe una continuidad operativa entre las actividades propias del transporte y las relativas a la manipulación de mercancías, desde una perspectiva jurídica, dichas operaciones pueden desarrollarse en régimen de autoprestación, o en el marco del propio contrato de transporte, o a través de un contrato autónomo de manipulación de mercancías.
La LNM contempla un régimen de responsabilidad propio para el manipulador portuario, lo que no impide que -llegado el caso- se pueda beneficiar de otros regímenes previstos por el mismo cuerpo legal.
[Abstract] Port handling activities involve a set of operations that are primarily technical and material in nature, carried out before and after the transfer of goods, and conducted within the port area. These operations are essential for the effective performance of cargo transportation. Although there is an operational continuity between the activities inherent to carriage and those related to the handling of goods, from a legal standpoint, such operations may be performed either under a self-provision regime, or within the framework of the carriage of goods contract itself, or -finally- through an independent contract for the handling of goods. The LNM -Marine Navigation Act- establishes a specific liability regime for port handlers, which does not preclude them —when applicable— from benefiting from other liability regimes provi¬ded by the same legal framework.
