Abstract
[Resumen] La Sentencia de 12 de diciembre de 2019 del Tribunal de Justicia de la Unión Europea declaró discriminatorio por razón de sexo el complemento de aportación demográfica reconocido en la legislación española solo a favor de las madres. A causa de esa Sentencia, la legislación española sustituyó ese complemento de aportación demográfica por otro de brecha de género, reconocido a todas las madres y a los padres solo bajo determinadas condiciones. La Sentencia de 15 de mayo de 2025 del Tribunal de Justicia de la Unión Europea también declara discriminatorio el nuevo complemento.
[Abstract] The judgment of December 12, 2019, of the Court of Justice of the European Union declared the demographic contribution supplement recognized in Spanish legislation only in favor of mothers to be discriminatory on the basis of sex. Following this judgment, Spanish legislation replaced this demographic contribution supplement with a gender gap supplement, recognized for all mothers and fathers only under certain conditions. The judgment of May 15, 2025, of the Court of Justice of the European Union also declared the new supplement discriminatory.
