El trabajador con funciones de compliance officer en la empresa, en Europa y España

Abstract

[Resumen] La finalidad del presente trabajo es analizar la regulación legal del sistema actual de prevención de riesgos penales en la empresa en Europa y España. El desarrollo de una política de gestión del cumplimiento normativo deberá abarcar a la totalidad de la organización empresarial, ya que, en caso contrario, la empresa asumirá responsabilidad penal. Así, los ordenamientos de los países europeos como España, Francia, Alemania o Italia y también algunos entes internacionales como la Unión Europea, el Consejo de Europa, la OCDE etc., han desarrollado mecanismos de cumplimiento de la misma. La figura del Compliance Officer está sin lugar a dudas llamada a ocupar esta función en el organigrama empresarial. Habiéndose creado una nueva actividad laboral, realmente singular. Se analiza, a través de fuentes secundarias, como legislación y doctrina, la organización de los sistemas de prevención, las funciones y la responsabilidad que asumen tanto la empresa como el oficial de cumplimiento. Además, se lleva a cabo una comparativa con la prevención de riesgos laborales en la empresa.

[Abstract] The aim of this paper is to analyse the legal regulation of the prevention system of criminal risks in the company, in Europe, and in Spain. The development of a policy of management of regulatory compliance should cover the entire business organization, since, otherwise, the company will assume criminal responsibility. Thus, the regulations of European countries such as Spain, France, Germany or Italy and also some international bodies such as the European Union, the Council of Europe, and the OECD etc. have developed compliance mechanisms. The figure of the Compliance Officer is undoubtedly called to occupy this role in the business organization chart. This figure is analysed through secondary sources, such as legislation and doctrine, the organization of the prevention systems, the functions and the responsibility assumed by both the company and the compliance officer. In addition, a comparison is made with the prevention of occupational risks in the company.
