[Resumen]: Una reciente Sentencia del Pleno de la Sala de lo Social
del Tribunal Supremo anuncia un cambio de doctrina
en la compatibilidad entre pensión de incapacidad
permanente absoluta y de gran invalidez con un trabajo,
en este caso con la venta de cupones de la ONCE, que
hasta la fecha era jurisprudencialmente pacífica. Basa
sus razones en la interpretación literal y sistemática,
unida a la realidad social del momento, estableciendo
ahora la incompatibilidad de la pensión de incapacidad
permanente absoluta o de gran invalidez con un trabajo
habitual y con ingresos regulares. Aquí se contrasta
la situación anterior, donde percibir una pensión de
incapacidad permanente absoluta y ejercer un trabajo era
admitido por abundante jurisprudencia, con el análisis de
la nueva doctrina del Tribunal Supremo.
[Abstract]: A recent ruling by the Supreme Court’s Social Chamber plenary has announced a change in doctrine regarding the compatibility between permanent absolute disability or severe disability pensions and employment, in this case with selling lottery tickets for ONCE, which until now was considered permissible under settled case law. The Court bases its reasoning on a literal and systematic interpretation, along with the social reality of the moment, now establishing the incompatibility of these pensions with habitual work and regular income. This article contrasts the previous situation, where receiving a permanent absolute disability pension and working was allowed by abundant case law, with the new doctrine established by the Supreme Court.
