Resumen
[Resumen] A pesar de su título, la Ley 12/2023, de 24 de mayo, no supone el reconocimiento legislativo de un derecho a la vivienda, de manera que no puede considerarse cumplida la Resolución Parlamento Europeo de 21 de enero de 2021 sobre el acceso a la vivienda digna y asequible para todos y, en consecuencia, tampoco que se garantice este derecho, declarado como un derecho fundamental en la STJUE 10 de septiembre de 2014 (asunto C-34/13; Monika Kušionová y SMART Capital, a.s.). El legislador español no configura el derecho al disfrute de una vivienda como un derecho subjetivo ejercitable frente a los poderes públicos y ello pese al reconocimiento meramente formal del derecho «a disfrutar de una vivienda digna y adecuada, en los términos dispuestos por esta Ley» (art. 8.1 de la Ley 12/2023), que se concibe como un instrumento al servicio de las Administraciones Públicas para alcanzar los objetivos marcados en sus planes; al tiempo que se imponen ciertos límites a los propietarios de vivienda (especialmente en el caso de los grandes tenedores). Estos límites se vinculan, particularmente, al deber del propietario de destinar la vivienda al uso habitacional o residencial que le es propio y a proteger a ocupantes de una vivienda en supuestos de vulnerabilidad económica. [Abstract] Despite its name, the Spanish statute 12/2023 of 24 May, does not come to legally recognize a right to adequate housing, so that it cannot be understood as the means to comply with the European Parliament resolution of 21 January 2021 on access to decent and affordable housing for all. Therefore, one cannot say, as a result of the new legislation, that this right is now guaranteed in Spain; although it is a right which was qualified as fundamental by ECJ decision of 10 September 2014 (case C-34/13; Monika Kušionová y SMART Capital, a.s.). The new Spanish legislation does not allow to exercise the right to adequate housing against the State, although it formally declares that all have "the right to enjoy an adequate and decent home, according to the terms of this statute" (art. 8.1 of statute 12/2023). On the contrary, the statute is designed as a legal toolbox for the Spanish public administration to reach the goals defined in its policy plans. At the same time, it sets up some limitations to the real estate owners (especially in the case of the so-called «big land owners»). These limitations are linked to the duty of the owners to dedicate their houses only for residential purposes and to protect the tenants in the event that they fall into a situation of economic vulnerability.
