Abstract
[Resumen] El Derecho penal romano experimenta un pronto desarrollo de la mano de
una lex horrendi carminis introducida para combatir los más graves delitos que un
romano podía cometer en la comunidad. Los reos, en un período en que Derecho y
religión son interdependientes, son señalados como hombres malditos, y por ello su
procesamiento es excepcional, así como su ejecución. La primitiva severidad con que se
aplican los castigos se va atemperando durante la República hasta desaparecer. [Abstract] The Roman criminal law undergoes an early development by the hand of a
lex horrendi carminis that is presented to combat the most serious crimes that a Roman
can commit in the community. The prisoners, in a period in which Law and Religion are
interdependent, will be designated as cursed men, and therefore their processing will be
exceptional, as well as their execution. The primitive severity with which the
punishments are applied is tempered during the Republic until it disappears.
