Abstract
[Resumen] Para disfrutar plenamente de los derechos humanos se requiere de Cortes internacionales competentes en tales materias, de lo contrario se desplomaría todo espíritu dogmático. Por tal razón analizaremos si las respuestas jurisdiccionales internacionales son coherentes con cada momento histórico. Observaremos que tales derechos ya no pueden garantizarse solo con sistemas regionales, sino que debemos orientarnos hacia una Corte especializada y universal. Actualmente hay Cortes continentales especializadas y sub-continentales no especializadas generándose una coexistencia y superposición territorial en Europa, América y África de singulares características, sobre todo, en cómo las Cortes no especializadas, obtuvieron sus competencias en derechos humanos, afectando al principio de atribución de competencias que rige en la dimensión transnacional de la jurisdicción. [Abstract] The effective enjoyment of human rights requires competent international Courts in such spheres, otherwise every dogmatic spirit collapses. For this reason we will analyze if the international jurisdictional answers are coherent with each historical moment. We will observe that these rights can no longer be guaranteed only with regional systems. But we must orient ourselves towards a specialized and universal Court. Currently there are specialized continental and sub-continental non-specialized Courts generating a coexistence with a spatial overlap in Europe, America and Africa, of exceptional characteristics, especially in how the non-specialized Courts came to have human rights competencies, stressing the principle of competence attribution that governs in the transnational dimension of the jurisdiction.
