Quebrados ex vitio e inmunidad eclesiástica

Abstract

[Resumen] Este estudio tiene por objeto el acercamiento a la colocación jurídica de los quebrados fraudulentos; de su homologación penal, o no, a los fures publici dependerá su sanción penal y con ella su posibilidad, o no, de gozar de la inmunidad eclesiástica. Parto del análisis de un punto específico – los decocti fraudulenti y la inmunitas ecclesiae - de dos bulas papales de la segunda mitad del siglo XVI: la constitución Postquam eosque (1570) de Pío V y la Cum alias (1591) de Gregorio XIV. Interpreto la literatura jurídica europea del siglo XVII sobre el alcance y contenido de las mencionadas disposiciones papales y demuestro el pensamiento uniforme de los juristas y de la legislación hispana, así como la disparidad de argumentaciones de la literatura jurídica extra hispana.

[Abstract] The aim of this study is to find out the legal situation of the fraudulent bankrupts; depending on their assimilation to the fures publici their penalty will be one or other, and they will have or not the possibility to take profit of ecclesiastical immunity. I start my analysis from the decocti fraudulenti and the inmunitas ecclesiae of two bulls dated on the second part of the XVIth century: the Postquam eosque Constitution (1570) from Pio V and the Cum alias (1591) from Gregorio XIV. My interpretation from the European juridical literature of the XVIIth century is based on this Pope´s bulls content. This way, I get to show the uniformity that existed on the jurists thinking and the Hispanic legislation, as the different juridical literature extra hispana argumentations.
