Abstract
[Resumen] El presente trabajo pretende analizar los límites al principio de soberanía en dos períodos concretos: en la antigüedad romana, donde, en el transito entre la República y el Principado, la figura de Cicerón vino a ponderar los valores, principios e instituciones republicanas, y lo hizo recurriendo a la defensa de la libertad, de la clase de los optimates, de una constitución mixta y de la Ley Natural; y en la Baja Edad Media, donde, frente al poder político y jurídico del emperador, cabe observar cómo el papado, las leyes paccionadas y la vigencia de los principios de la ley natural fueron elementos que vinieron a limitar la soberanía del monarca. [Abstract] This paper analyzes the limits to the principle of sovereignty in two specific periods: in ancient Rome, where, in transit between the Republic and the Principality, the figure of Cicero came to weigh the values, principles and republican institutions and did so by resorting to the defense of freedom, the kind of optimates, a mixed constitution and the Natural Law, and Middle Ages, where, against the political and legal power of the emperor, it is noted how the papacy, Paccione laws and the observance of the principles of natural law were elements that came to limit the sovereignty of the monarch.
